These Terms & Conditions ("Terms") govern your use of fusionbydesign.co.za and the web design, development and related services provided by Fusion By Design ("we", "us", "our"). By accessing this website or engaging our services, you agree to be bound by these Terms.

3. Our services

We provide professional web design and development services as agreed with each Client. The specific scope, deliverables, timeline and fees for any project will be set out in a quotation or proposal provided to the Client before work begins.

4. Quotations & fees

All quotations are valid for the period stated and are based on the scope of work described at the time. Any work requested beyond the agreed scope may be subject to additional fees, which we will communicate before proceeding.

Prices displayed on our website are starting points and may vary depending on project requirements.

5. Payment

Unless otherwise agreed in writing, a deposit may be required before work commences, with the balance payable on completion or as set out in the project quotation. We reserve the right to suspend work or withhold deliverables until outstanding payments are settled.

6. Client responsibilities

To deliver your project effectively, we rely on you to:

  • Provide accurate, lawful content and materials in a timely manner.
  • Give clear feedback and approvals within agreed timeframes.
  • Ensure you hold the rights to any materials you supply to us.

7. Revisions & approvals

Each project includes the number of revision rounds specified in the relevant quotation. Additional revisions beyond this may incur extra charges. Once deliverables are approved by the Client, further changes may be treated as new work.

8. Timelines

We will make every reasonable effort to meet agreed deadlines. However, project timelines depend on timely Client feedback, content and payments, and we are not liable for delays caused by factors beyond our control.

9. Intellectual property

Upon full payment, ownership of the final deliverables produced specifically for the Client transfers to the Client, except for any third-party assets, licensed materials, or our own pre-existing tools, frameworks and components, which remain the property of their respective owners.

We reserve the right to display completed work in our portfolio and marketing materials unless otherwise agreed in writing.

10. Third-party materials

Our services may incorporate third-party software, plugins, fonts, images or services. These are subject to their own licences and terms, and we are not responsible for changes, failures or costs associated with third-party products.

11. Hosting & domains

Where hosting and domain services are required, these are provided through our hosting platform, Atomic Hosting (https://atomichosting.co.za/), and are subject to its own terms of service. Hosting and domain fees are separate from design and development fees.

12. Warranties & liability

We provide our services with reasonable skill and care. However, we do not warrant that the website or any deliverable will be uninterrupted, error-free, or compatible with all future software or devices. To the maximum extent permitted by law, our liability for any claim arising from our services is limited to the fees paid for the relevant project.

13. Termination

Either party may terminate an engagement in writing. In the event of termination, the Client remains liable for all work completed up to the date of termination. Any deposits paid are non-refundable to the extent that work has already been performed.

14. Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, and any disputes shall be subject to the jurisdiction of the South African courts.

15. Changes to these Terms

We may update these Terms from time to time. The latest version will always be available on this page, with the effective date updated accordingly.
